Terms of Service

Version: draft · Draft updated: 2026-10-12

This is a translation; in case of any difference, the Hungarian version prevails.

Currently only the website and the launch waitlist are available. The sections describing the app prepare for its later launch. The waitlist is free; Pro subscriptions, Gig credits and paid promotion cannot currently be purchased.

1. The provider and the service

The Yartist™ mobile app (“Yartist”) is operated by OFFICEXPERTS Kft. (registered office: Gyár utca 2., 2040 Budaörs, Hungary; company registration number: Cg. 13-09-197492; tax number: 14585641-2-13) (the “provider”). Yartist connects creative freelancers and clients for specific jobs: the client posts a job (a Gig), both sides show their interest by swiping right (interested) or left (not interested), and when both are interested (a match), they can talk in a chat.

The service is used under these terms and the privacy notice. By registering and accepting them, the user agrees to them.

About the contract concluded electronically:

  • The contract between the user and the provider is concluded by registering and accepting these terms, for an indefinite period.
  • The contract is not a written contract; the provider does not file it, and the current and earlier versions of these terms are available on this page.
  • The language of the contract is Hungarian; translations are for information only.
  • The steps of registration are shown in the app; users can check and correct their data before submitting it, and change it in their account afterwards.
  • The provider has not subscribed to a code of conduct.

2. Registration and account

  • Only persons aged 18 or over may use Yartist.
  • An account may have a freelancer and a client profile; the user switches between them.
  • The user gives true data, keeps their sign-in details secret and is responsible for what happens in their account.
  • One person may keep one account.
  • The provider does not verify users' identity; a confirmed email address only means that the user has access to it.

3. Yartist's role: an intermediary

Yartist is an online intermediation (hosting) service. The provider is not a party to the engagements between users: it is not an employer, not a client and not a payer, it does not select freelancers, assign work or set prices. The parties agree on the content, fee, deadline, usage rights and other terms of the work directly, and are responsible for its performance.

  • The engagement is concluded solely between the client and the freelancer. The provider does not represent either party and makes no statements on their behalf.
  • Profiles, works, Gigs and messages are published by the users, who are responsible for them. The provider does not guarantee that an offer is genuine, that the parties reach an agreement, or that the work is delivered and matches the agreement.
  • Yartist does not offer the freelancers' work as its own service: the work is always done by the freelancer named on the profile, in their own name and at their own responsibility.

4. Payment

Yartist is currently free. The parties pay and invoice each other outside the app; the provider takes no part in it, does not handle or transfer the money, and is not responsible for the payment, for its absence or for recovering it. Payments outside the app are at the parties' own risk.

If paid features (such as a subscription) or in-app payment start in the future, their terms (price, duration, cancellation, withdrawal, handling of the money, disputes) will be announced in advance and presented for separate acceptance (see section 18).

5. Profile, portfolio, approval

  • A freelancer's profile and portfolio are shown to clients only after the provider has reviewed (approved) them; we aim to decide within 48 hours.
  • The objective conditions of approval: the required data is filled in; the portfolio has at least 3 works of recognisable quality that fit the chosen craft; the works appear to be the freelancer's own; the rate is realistic; there is no prohibited content (section 7) and no contact details in the profile.
  • Approval only means that the profile met the conditions above at the time of the decision. It does not certify, recommend or guarantee the freelancer's identity, qualifications, reliability or the quality of their work.
  • The portfolio may only contain the user's own work, or work they have the right to show (for example with the client's consent).
  • The provider may ask for changes, or reject the profile or single works, with a reason code and an explanation. New works of an approved profile are reviewed the same way before they are shown.
  • Uploaded content remains the user's; the user grants the provider the non-exclusive, free permission needed to run the service (storage, resizing, display to other users), which ends when the content is deleted.

6. Gigs

A Gig must be real, specific work with a real budget. A client may have at most one active Gig at a time; a Gig is active for 30 days and can be renewed. Gigs are checked automatically when published (contact details in the description, suspicious phrases, an unrealistic budget); a suspicious Gig is shown only after a human review by the provider, or is closed with reasons.

7. Prohibited content and conduct

  • fake profiles, presenting someone else's work as one's own;
  • fraud, obtaining advance payments, fees or personal data by deception;
  • harassment, threats, hate speech, sexual or violent content;
  • unsolicited advertising (spam), recruiting for other services;
  • requesting or taking on unlawful work, infringing others' intellectual property;
  • disrupting the service, automated access;
  • opening a new account after a ban, registering in someone else's name.

8. Reports, moderation, sanctions, appeals

  • Any profile, work, Gig, message or user can be reported in the app, or at abuse@yartist.app. A notice of illegal content should give: the reason, the exact location of the content (which profile, Gig or message), the name and email address of the person reporting, and a statement that they act in good faith, to the best of their knowledge.
  • The person reporting gets a confirmation and is told about the decision.
  • Content reported by three different users is hidden automatically until the provider's decision. Apart from this and the automatic check of Gigs (section 6), moderation involves no automated decisions: every measure is decided by a person.
  • The provider may dismiss the report, warn, remove or hide the content, suspend the user for a set time (e.g. 3, 7 or 30 days), or ban them. Every decision comes with reasons: what happened, under which rule, and how to appeal.
  • A decision can be appealed once in the app (Settings → Moderation decisions); a banned user appeals by email at hello@yartist.app.
  • If the provider becomes aware of a suspected criminal offence involving a threat to someone's life or safety, it informs the competent authorities without delay.
  • Users may block each other; a block affects only the two of them, and the other side is not notified.

9. Chat and sharing contact details

The chat is for the matched parties to agree. If we recognise a phone number, an email address or an external chat link in a message, both sides see a safety notice; sharing contact details is not prohibited. The provider only sees chat content on a report, for moderation, or on an official request. Conversations of unmatched or deleted accounts are kept for the period given in the privacy notice to investigate abuse, and are deleted afterwards.

10. Freelancers' freedom

Freelancers set their own rates, decide which work interests them, and may take work on other platforms or directly. Yartist does not set prices and does not assign work.

11. The main parameters of the ranking

The app puts the cards in order; the order is only a suggestion, the decision is always the user's. First we leave out what does not fit (craft, location and remote settings, availability, blocks, cards already decided), then we rank the rest by these parameters, roughly in decreasing weight:

  1. the other side has already shown interest (the chance of a mutual match);
  2. whether the freelancer's rate fits the Gig's budget;
  3. distance, for on-site work;
  4. freshness: a new profile or Gig, or a recently active user;
  5. the completeness of the profile, or the quality of the Gig's description;
  6. variety: someone already shown many times that day moves slightly back, and there is a small random factor that changes daily.

There is no paid promotion now; if we introduce it, we will say so here and mark the promoted content.

12. Taxes and lawful conduct

Every user is responsible for their own taxes, invoicing and lawful conduct. The provider is not an employer, a payer or a client between the parties, so it does not withhold taxes or contributions and does not file returns for them. General information is in the tax guide, which is not tax advice.

13. Business or private individual

  • Freelancers state on their profile whether they work as a private individual, a sole trader, a company or a member of a school cooperative. This is the freelancer's own statement; the provider does not verify it and is not responsible for it.
  • Consumer protection rights (for example the consumer rules of guarantees and warranties) apply only against a business. If the freelancer is a private individual, the engagement is governed by the general rules of the Civil Code, not by the rules of consumer contracts.
  • Clients should ask the freelancer about invoicing before the engagement; the freelancer must answer truthfully.

14. Disputes between users

  • Disputes about an engagement (for example the work was not delivered, does not match the agreement, or the fee was not paid) are settled between the parties. The provider does not decide disputes between the parties and cannot be required to perform, refund a fee or pay damages in place of the other party.
  • The provider may help within the law and the privacy notice: it takes reports, acts under section 8 in case of fraud or other breaches, and gives data to authorities on an official request (for example after a criminal complaint).
  • We recommend that the parties put the terms of the work (content, fee, deadline, usage rights, rounds of revisions) in writing, pay in instalments for larger work, and never send an advance payment or identity documents to an unknown party.

15. Intellectual property in commissioned work

The parties agree on the copyright in the finished work (for example a logo, photo or video) and on the manner, extent and duration of its use. The provider has no say in this and acquires no rights in the work created between the parties. Without an agreement, the rules of copyright law apply.

16. Reviews

  • Only the two parties of a match can review each other, and only after a confirmed engagement: the client marked the Gig as filled with this match, or either party answered that the engagement happened. A review can be written within 14 days of the confirmation, once, and cannot be edited afterwards.
  • Reviews are blind: once sent, a review stays hidden until the other party has written theirs too, or the 14 days are over, so neither party can react to the other's review.
  • Reviews are visible to other signed-in users. For a private author, their first name, profile picture, role (client or freelancer), the work's title and the date show; a client uses their client profile's own picture, and a company client uses its company name and logo. Surnames and contact details are not shown. An erased author appears as “Deleted user”, without a picture. The average shows from the first review.
  • A review is its author's own opinion. The provider does not check its content and is not liable for it; an unlawful review, or one that breaks our rules, can be reported (section 8).
  • Reviews are removed only for breaking the rules; never on request or for payment, and negative reviews are not filtered out. A review may not contain fees, contact details or personal data.

17. The provider's liability

  • The provider runs the service with due care, but is not liable for the truth or lawfulness of the data and content users give or publish, for agreements between the parties or their performance, or for payments outside the app.
  • The provider is liable for user content only if it became aware of its illegality and did not act without delay (did not remove it or disable access to it).
  • The service may pause temporarily for maintenance, faults or causes beyond the provider's control (for example a failure of the hosting or internet provider); the provider is not liable for damage arising from this.
  • Towards business users, the provider's liability is limited, to the extent permitted by law, to the fees the user paid to the provider in the 12 months before the damage occurred.
  • These limitations and exclusions do not apply to damage caused intentionally or by gross negligence, or to damage to life, physical integrity or health, and do not affect the rights consumers have by law.
  • Users are liable for damage they cause to the provider or third parties by breaching these terms or by unlawful content, and if a claim is brought against the provider for this reason, they must hold the provider harmless from its consequences.

18. Changes to these terms

Changes are announced in the app and by email at least 15 days before they take effect; the app asks for the new version to be accepted at the next use. Anyone who does not accept it may delete their account. For material changes affecting business users we keep the notice period required by law.

19. Termination and exclusion

  • Users may delete their account at any time (see Delete account).
  • The provider may suspend or ban a user for serious or repeated breaches, with reasons. A final exclusion of a business user is announced at least 30 days in advance, with reasons, unless the law provides otherwise or in case of serious abuse.
  • The provider may end the service with at least 30 days' notice; users can then download their data.

20. Complaints and contact

Complaints and questions go to hello@yartist.app, legal matters to legal@yartist.app. legal@yartist.app is also the designated point of contact for authorities, the European Commission and the European Board for Digital Services; users can reach us on any matter at hello@yartist.app. We communicate in Hungarian or English. We answer complaints within 30 days. Consumers may also turn to the conciliation body of their place of residence.

21. Governing law and disputes

These terms are governed by Hungarian law; consumers keep the protection of the mandatory rules of the law of their place of residence. The parties first try to settle disputes by negotiation; failing that, the Hungarian court with jurisdiction and competence decides, and for consumers also the court of their place of residence.
